the United States and Canada are detailed in a previous section.
EXTENSION OF THE STATUTORY RIGHTS
This limited manufacturer's warranty of Össur applies to the ultimate
purchaser of the RHEO KNEE 3/RHEO KNEE XC/SYMBIONIC LEG 3
® ® ®
("customer"). Statutory claims of the customer or claims of the customer
against the vendor/ retailer of the RHEO KNEE 3/RHEO KNEE XC/
SYMBIONIC LEG 3 are neither excluded or limited as a consequence
thereof.
WARRANTY PERIOD
Default warranty period is 24 months from the time of invoicing by
Össur. The preconditions for obtaining the 24-month cover under the
warranty must be met. In the event of resale or other change of owner/
user, the claim under the warranty will, for the remaining warranty period,
transfer to the new owner/user.
AREA OF VALIDITY OF THE WARRANTY
This limited manufacturer's warranty is valid and enforceable worldwide.
Additional guarantee ranging from 36-60 months, can be purchased
separately, at point of sales or at latest within 20 months after initial
purchase date. Total warranty of more than 36 months will include one
mandatory service check at 40 months.
SCOPE OF THE WARRANTY
Össur guarantees that the RK3/RK XC/SBL3 is free from any quality
defects at the time of delivery and that such a quality defect will also not
occur at a later point in time within the warranty period, provided that the
RK3/RK XC/SBL3 is used for its designated purpose. A quality defect is
understood to be the case when the RK3/RK XC/SBL3 is not in the
condition referred to in the functional description given in the product
documentation of the RK3/RK XC/SBL3 (part of the product package), in
which respect insignificant anomalies are not taken into account. Certain
cases, outlined in this document, are excluded from the warranty
coverage. During the warranty period, defective RK3/RK XC/SBL3 will, at
the sole discretion of Össur, be repaired or replaced, as the case may be,
either by Össur or an authorised distributor. The customer will either
receive the repaired RK3/RK XC/SBL3 from Össur or a functional
replacement. Exchanged parts or mounting parts will become the
property of Össur. Any additional claims against Össur cannot be made
pursuant to this limited manufacturer's warranty. Össur will only provide
service through clinicians that are trained and certified by Össur on the
use of this product.
ENFORCEABILITY OF THE WARRANTY
In order for the warranty payment to be enforceable, the defect must be
reported to Össur within thirty (30) days of such defect having occurred
within the warranty period. The defective RK3/RK XC/SBL3 must be sent
