Exchange of a Machine or Part
When the warranty service involves the exchange of a Machine or part, the item PROVO CRAFT replaces
becomes its property and the replacement becomes yours. you represent that all removed items are
genuine and unaltered. The replacement item assumes the warranty service status of the replaced item.
Your Additional Responsibilities
Before PROVO CRAFT exchanges a Machine or part, you agree to remove all features, parts, options,
alterations, and attachments not under warranty service.
You also agree to: 1.) Ensure that the Machine or part is free of any legal obligations or restrictions that
prevent its exchange; and 2.) If you do not own the Machine, obtain authorization from the owner to have
PROVO CRAFT service the Machine.

Limitation of Liability

EXCLUSIVE REMEDY: THE EXCLUSIVE AND SOLE REMEDY UNDER THIS LIMITED WARRANTY IS THE
REPLACEMENT OF THE DEFECTIVE MACHINE OR PARTS AS SPECIFIED ABOVE. PROVO CRAFT EX-
PRESSLY EXCLUDES ANY AND ALL LIABILITY FOR INCIDENTAL AND CON-SEQUENTIAL LOSSES, DAM-
AGES AND EXPENSES ARISING FROM ANY PRODUCT DEFECT, OR OTHERWISE, TO THE MAXIMUM
EXTENT PERMITTED BY LAW. WITHOUT LIMITING THAT EXCLUSION, PROVO CRAFT ALSO EXPRESSLY
EXCLUDES ANY LIABILITY FOR INJURIES AND LOSSES TO PROPERTY THAT RESULT FROM THE OPERA-
TION, PROPER OR IMPROPER, OF A MACHINE, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROVO CRAFT EXPRESSLY EXCLUDES LIABILITY FOR
ANY LOSS OF USE OF A MACHINE, INCONVENIENCE OR DAMAGES OF ANY CHARACTER, WHETHER
DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL (INCLUDING, BUT NOT LIMITED TO, DAMAGES
FOR LOSS OF GOODWILL, LOSS OF REVENUE OR PROFIT, WORK STOPPAGE, FAILURE OF OTHER
EQUIPMENT TO WHICH A MACHINE IS CONNECTED, LOSS OF INFORMATION OR MATERIALS THAT
THE MACHINE IS USED WITH), OR OTHERWISE RESULTING FROM THE USE OF THE MACHINE, RELAT-
ING TO WARRANTY SERVICE, OR ARISING OUT OF ANY BREACH OF THIS LIMITED WARRANTY, EVEN
IF PROVO CRAFT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE MAXIMUM
LIABILITY OF PROVO CRAFT UNDER THIS LIMITED WARRANTY IS LIMITED TO THE PURCHASE PRICE
OF THE MACHINE.
THE FOREGOING EXPRESS WRITTEN WARRANTIES AND REMEDIES ARE EXCLUSIVE AND ARE IN LIEU
OF ANY OTHER WARRANTIES OR REMEDIES, EXPRESS, IMPLIED OR STATUTORY.
UNDER NO CIRCUMSTANCES IS PROVO CRAFT, OR ITS SUPPLIERS OR RESELLERS LIABLE FOR ANY
OF THE FOLLOWING EVEN IF INFORMED OF THEIR POSSIBILITY: 1) THIRD PARTY CLAIMS AGAINST
YOU; 2) SPECIAL, INCIDENTAL, OR INDIRECT DAMAGES OR FOR ANY ECONOMIC CONSEQUENTIAL
DAMAGES; 3) LOSS OF OR DAMAGE TO ANY MATERIALS USED IN THE MACHINE OR 4) LOST PROFITS,
BUSINESS REVENUE, GOODWILL, OR ANTICIPATED SAVINGS.
SOME STATES OR JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS ON DAM-
AGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
PROVO CRAFT IS RESPONSIBLE FOR LOSS OF, OR DAMAGE TO, YOUR MACHINE ONLY WHILE IT IS
1) IN PROVO CRAFT'S POSSESSION OR 2) IN TRANSIT IN THOSE CASES WHERE PROVO CRAFT IS
RESPONSIBLE FOR THE TRANSPORTATION CHARGES.
Governing Law
Both you and PROVO CRAFT consent to the application of the laws of the country in which you acquired
the Machine to govern, interpret, and enforce all of your and PROVO CRAFT's rights, duties, and obliga-
tions arising from, or relating in any manner to, the subject matter of this Statement of Limited Warranty,
without regard to conflict of law principles.
THESE WARRANTIES GIVE YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS
WHICH VARY FROM STATE TO STATE OR JURISDICTION TO JURISDICTION.
Jurisdiction
All of our rights, duties, and obligations are subject to the courts of the country in which you acquired
the Machine.
