Limited warranty
In The Ditch Towing Products (ITD) gives a warranty to the original purchaser that every newly manufactured
item from ITD will be free of material and processing faults for a period of twelve (12) months after initial
operation. The purchaser is required to inform ITD immediately in writing of any material
and processing faults. ITD will under no circumstances take into account notifications received later than
twelve (12) months after the start of operation.
ITD's obligations under this warranty, whether statutory or otherwise, shall be limited to repair and replace-
ment by the ITD manufacturing facility, or any other facility designated by ITD, of parts that exhibit material
and processing faults after inspection by ITD. This warranty is non-transferable. This warranty does not require
ITD to cover labour costs and transport charges in connection with the repair or replacement of defective
parts and does not extend to any repair of items unauthorised by ITD.
Except as expressly stipulated below, ITD gives no other warranties, express or implied, and excludes all other
warranties, including (but not limited to) the implied warranties of merchantability and fitness for a particular
purpose. In no event shall ITD be liable for any loss of production, loss of goodwill or any other special conse-
quential or incidental damages relating to articles and individual parts. This is irrespective of whether it is due
to negligence, fault liability, breach of contract, breach of warranty, misrepresentation or any other legal event,
and it is irrelevant whether the losses were the result of a general or specific condition of which ITD was aware
or should have been aware at the time of sale.
ITD gives no warranties, express or implied, with respect to finished products supplied to ITD by other manu-
facturers, including (but not limited to) vehicles to which an ITD product is attached or additional accessories,
and ITD expressly disclaims any warranty of merchantability and fitness for a particular purpose of such mate-
rials and products. This contract does not in any way affect or diminish the rights of the purchaser regarding
guarantees of other manufacturers and suppliers. IWS gives warranties of such manufacturers and suppliers
to the purchaser to the extent permitted by law.
Clients must obtain and present a written authorisation number from ITD before commencing the repair work,
and the client agrees to bear all costs. Please note: Goods for which a manufacturer's warranty exists must
be returned directly to the manufacturer for repair or replacement
by the manufacturer. ITD has set itself the task of constantly improving its products and reserves the right to
make improvements to its products deemed necessary by means of changes in design and materials without
entering into any obligation to make these changes to products already sold.
This warranty does not extend to the following items, which are listed here as inclusive but not exclusive:
normal wear and tear of the fairing, paintwork and lettering, appearance as a result of weather-related wear
and tear or wear and tear due to road conditions or surface, etc., damage or faults caused by accident,
misuse, neglect, operation above nominal load, improper or unauthorised repairs, inadequate or inappropriate
maintenance, improper use, or changes and changes affecting performance, operation or reliability.
