Liability and warranty

• Liability :
1) ERARD will not be liable for any damage or injury
caused by incorrect mounting, incorrect assembly, or
incorrect use.
2) Customer shall notify ERARD of defective or faulty
parts within thirty (30) days as of delivery of the Light
®
Motion . Failure to notify ERARD timely will void all
warranty.
3) ERARD shall not be liable for defects of
parts/components manufactured by third parties.
4) ERARD shall not be liable for any third party claims
subsequent to the resale of the Light Motion
5) ERARD cannot be liable for injury due to insufficient
caution during installation.
• Exclusions and limitations of warranty and
liability :
This Limited Warranty applies only to Light Motion
products manufactured by ERARD that can be
identified by the "Light Motion
name, or logo affixed to then.
Non-ERARD manufacturers, suppliers, or publishers
may provide a separate warranty for their own
products packaged with Light Motion
This warranty does not apply to, and shall be forever
voided by: (a) damage caused by incorrect mounting,
incorrect assembly, incorrect use, failure to follow
these instructions, accident, negligence, lightning,
water damage, fire, abuse, poor storage conditions,
misuse, misapplication, (b) to non-ERARD products; (c)
damage caused by service performed by anyone other
than ERARD or a repair facility pre-approved by
ERARD; (d) a product or a part that has been modified
without the written permission of ERARD; or (e) if any
ERARD serial number has been removed or defaced.
TO THE MAXIMUM EXTENT PERMITTED BY LAW,
THIS WARRANTY AND THE REMEDIES SET FORTH
ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER
WARRANTIES, REMEDIES AND CONDITIONS,
WHETHER ORAL OR WRITTEN, EXPRESS OR
IMPLIED. ERARD SPECIFICALLY DISCLAIMS ANY AND
ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT
LIMITATION, WARRANTIES OF MERCHANTABILITY

AND FITNESS FOR A PARTICULAR PURPOSE. IF
ERARD CANNOT LAWFULLY DISCLAIM OR EXCLUDE
IMPLIED WARRANTIES UNDER APPLICABLE LAW,
THEN TO THE EXTENT POSSIBLE ANY CLAIMS
UNDER SUCH IMPLIED WARRANTIES SHALL EXPIRE
ON EXPIRATION OF THE WARRANTY PERIOD. NO
ERARD RESELLER, AGENT, OR EMPLOYEE IS AUTHO-
RIZED TO MAKE
EXTENSION, OR ADDITION TO THIS WARRANTY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW,
ERARD IS NOT RESPONSIBLE FOR DIRECT, SPECIAL,
INCIDENTAL OR CONSEQUENTIAL DAMAGES
RESULTING FROM ANY BREACH OF WARRANTY
OR CONDITION, OR UNDER ANY OTHER LEGAL
THEORY, INCLUDING ANY COSTS OF RECOVE-
RING OR REPRODUCING THE ERARD PRODUCT,
AND ANY FAILURE TO MAINTAIN THE CONFIDEN-
TIALITY. ERARD SPECIFICALLY
REPRESENT THAT IT WILL BE ABLE TO REPAIR ANY
PRODUCT UNDER THIS WARRANTY.
FOR CONSUMERS WHO HAVE THE BENEFIT OF
CONSUMER PROTECTION LAWS OR REGULA-
TIONS IN THEIR CITY, COUNTRY, STATE OR
COUNTRY OF PURCHASE OR, IF DIFFERENT, THEIR
CITY, COUNTRY, STATE OR COUNTRY OF
RESIDENCE, THE BENEFITS CONFERRED BY THIS
WARRANTY ARE IN ADDITION TO ALL RIGHTS AND
REMEDIES CONVEYED BY SUCH CONSUMER
PROTECTION LAWS AND REGULATIONS. TO THE
EXTENT THAT LIABILITY UNDER SUCH CONSUMER
PROTECTION LAWS AND REGULATIONS MAY BE
LIMITED, ERARD'S LIABILITY IS LIMITED, AT ITS SOLE
OPTION TO REPLACEMENT OR REPAIR OF THE
PRODUCT OR SUPPLY OF THE REPAIR SERVICE
AGAIN.
