WARRANTY
You are eligible for a lifetime warranty for your O'Plancha if you request one via
warrantymastrad.com during the month following the purchase of the product. The warranty
will only take effect once your request has been made. Mastrad's warranty for the stainless-
steel O'Plancha covers usage of the product under normal conditions that respect the use
and care instructions listed in the manual provided with the product. The warranty does not
cover accessories sold separately or in conjunction with the product. The warranty is open
to private individuals and applies to household use of the product and excludes professional
use (restaurants, cooking schools, etc.). In order to exchange your product, please send your
product to the following address: SAV MASTRAD, 32 bis – 34 Boulevard de Picpus, 75012 Paris,
FRANCE. The conditions do not apply if the article has been damaged, bent, or dismantled. This
warranty only applies within the European Union and in countries belonging to the European
Free Trade Association in which MASTRAD products are available for sale to customers residing
in the countries mentioned above. In France, this is an extension of the legal warranty and the
warranty of secret defects in the conditions of articles L.211-4, L.211-5, and L.211-12 of the
Consumer Code and 1641 of the Civil Code. Mastrad remains bound by the legal conformity
warranty listed in articles L. 211-4 to L. 211-13 of the present code and that relating to defects
of the sold item, in the conditions laid out in articles 1641 to 1648 and 2232 of the Civil Code.
These articles are the following: Legal conformity warranty: Article L211-4 of the Consumer
Code: The vendor is required to deliver a product that complies with the contract and shall be
liable for any non-compliances existing upon delivery. The vendor shall also be liable for any
non-compliances resulting from the packaging, the assembly or the installation instructions
where the vendor is liable under the contract for assembly/installation or where it was carried
out under the vendor's responsibility. Article L211-5 of the Consumer Code: To comply with
the contract, the product must: 1) Be fit for the use normally expected of an item of its type
and, where appropriate: correspond to the description given by the vendor and possess all
the qualities presented to the buyer or the vendor in the form of a sample or a model; have
the qualities that a purchaser can legitimately expect given the public statements made by the
vendor, producer or his/her representative, particularly in advertising or labeling; 2) Or have the
characteristics defined by mutual agreement by the parties or be fit for all special uses sought
by the purchaser which the vendor was made aware and accepted. Article L211-7 of the
Consumer Code: Any lack of conformity which becomes apparent within six months of delivery
of the goods shall be presumed to have existed at the time of delivery unless proven otherwise.
The vendor can challenge this presumption if it is not compatible with the nature of the goods
or the lack of conformity invoked. Article L211-12 of the Consumer Code: Legal action based
on non-compliance is time-barred two years after the delivery of the product. Warranty of secret
defects: Article 1641 of the Civil Code: The vendor is bound to warranty in respect of secret
defects in the item sold which render it improper for the use to which it is destined, or which
so far diminish such use, that the buyer would not have purchased it, or would not have given
so large a price, if he had known them. Article 1648 of the Civil Code: The action resulting from
faults annulling the sale must be brought by the purchaser, within two years after discovery of
the defect.
