(vi) breakage;
(vii) damage caused by liquids or moisture, humidity, dust, or
extreme thermal or environmental conditions or rapid
changes in these conditions;
(viii) improper storage;
(ix) damage resulting from third-party software;
(x) repairs, installations, additions, changes and/or any kind of
technical handling by any entity, person, or service point
which has not been authorized to do so by Siyata Mobile;
(xi) accidents, fall, fire, flood, windstorm, lightning, earthquake,
exposure to extreme weather conditions, electrical surge or
improper voltage;
(xii) mobile phones in which the serial number is missing or has
been altered, damaged or defaced;
(xiii) use of accessories that have not been approved by Siyata
Mobile; and/or
(xiv) any other reason not related to the design, manufacture, or
shipment of the Product by or on behalf of Siyata Mobile.
10. This Warranty will not apply to the Product, and the customer will
not be compensated by this Warranty, in the following instances:
– The customer did not submit the Product for repair during
the course of the Warranty Period.
– Defects resulting from intentional vandalism.
– The identifying serial number on the Product's identification
label, or the date code on the accessory, have become
illegible and/or were removed and/or were erased and/or
were altered.
– Where lack of availability and/or operational range and/ or
coverage by the cellular service and/or malfunction in the
"mobile radio telephone system" operated by and on behalf
of whomever was authorized to do so by the regulatory
authority, and/or because of excessive load on their wireless
system, and/or because of any wireless disruption which was
not caused by any defect in the Product.
