3. Warranty
3.1
Definition
The warranty covers free replacement or repair
of equipment parts found to be defective due to
manufacturing defects.
3.2
Purpose
The following general warranty conditions
apply to the contractual relationships ex-
isting between the Distributors of MAHLE
Aftermarket
S.p.A.
and the users of the products (buyers).
These conditions include and replace the stat-
utory warranties for defects, and exclude any
other possible liability of the distributor and the
manufacturer arising from the products sup-
plied. In particular, the requirements set out in
Legislative Decree 24/2002 (Directive 2019/771/
EU) do not apply to supply relationships exist-
ing between the Distributors of MAHLE After-
market S.p.A products and Buyers, since they
apply to the supply of goods to consumers, i.e.
to any natural person who, within the scope of
the contract, acts for purposes not related to
products
(distributors)
the entrepreneurial or business activity. There-
fore, the Buyer may not make any further claims
other than those provided for in these warranty
conditions, regarding compensation for damage,
price reduction, or termination of the contract.
After the warranty period has expired, no further
claims can be made against the distributor or
manufacturer.
3.3
Warranty period
24 (twenty-four) months from the date of
n
activation (except for other sales configu-
rations)
3.4
Exclusions
The above warranty is applicable only after full
payment of equipment, therefore, in case of sus-
pension of payment for any reason, the buyer will
not be entitled to claim it.
No warranty is further applicable for any parts
found to be defective in the event of:
